SHIP'N SAVE TERMS AND CONDITIONS

“SHIP'N SAVE” provides carriage of documents and parcels for the account of its client herein after the “shipper” through an international network in which SHIP'N SAVE is a participant. The carriage is governed by the present contract.

I. General Conditions

The “shipper” accepts all Terms and Conditions stipulated at www.shipnsave.ca and certifies that all the information supplied is correct and has been validated.

2. If no service level is chosen on a ship order, SHIP'N SAVE will forward shipments sent within Canada and to the United States as a “Next Day’’ service level. As for International destinations, the “Express’’ service level will be applied.

3. The goods described in the present contract are accepted for carriage in apparent good condition unless specifically indicated on the ship order.

4. In order to speed up carriage, SHIP'N SAVE may substitute another carrier including a land carrier without affecting the nature and conditions of this contract.

5. SHIP'N SAVE does not accept in the present contract, passports, jewelry, tobacco, alcohol, art work, glass items, perishables, traveler’s checks, cash, as well as certain dangerous goods. Some items may be shipped at shipper’s risk.

6. The “shipper” must provide all pertinent information on the contents and value of the shipment, which will be necessary for any customs authority or other authorities and will be responsible for any damage resulting from false, erroneous or contradictory statements.

7. All duties and taxes relating to shipments will be charged to the consignee, unless prior notice is given to SHIP'N SAVE.

II. Delivery

Delivery times are directly related to the carrier used and the service chosen.

SHIP'N SAVE cannot guarantee delivery time. Service failure refunds are not offered on discounted express services.

III. Limitation of Liability

1. If the carriage involves an ultimate destination or a stop in a country other than the country of departure, the liability of SHIP'N SAVE may be submitted to the Warsaw Convention which governs and in most cases limits the liability of the carrier for loss, damage or delay to the goods unless a declared value (insurance) has been written on the contract before departure, in which case an additional amount can be charged to the “shipper”. In no circumstances will the liability of SHIP'N SAVE exceed the liability of the actual carrier.

2. The LIABILITY OF SHIP'N SAVE IN CASE OF LOSS OR PHYSICAL DAMAGES TO A SHIPMENT will be limited to the maximum amount of One Hundred Canadian dollars ($100) unless additional insurance has been purchased. This limit will be applicable even in the case of fault or negligence on the part of SHIP'N SAVE.

3. In case of loss or physical damages to a shipment, SHIP'N SAVE will not be liable FOR LOSS OF INCOME OR PROFIT(S) WHETHER OR NOT SHIP'N SAVE HAD KNOWLEDGE THAT SUCH DAMAGES MIGHT BE INCURRED. SHIP'N SAVE will not be liable for your acts or omissions, including but not limited to incorrect declaration of cargo, improper or insufficient packing, securing, marking or addressing of the shipment, or for the acts or omissions of the recipient or anyone else with an interest to the shipment. Also,

SHIP'N SAVE will not be liable if the shipper or the recipient violates any of the terms of this agreement. SHIP'N SAVE will not be liable for damage, loss, delay, shortage, mis-delivery, non-delivery, misinformation, or failure to provide information in connection to this shipment caused by events SHIP'N SAVE cannot control, including but not limited to acts of God, perils of the air, weather conditions, mechanical delays, acts of public enemies, war, strikes, civil commotions, or acts or omissions of public authorities (including customs and health officials) with actual or apparent authority.

4. SHIP'N SAVE does not extend service failure refunds if rates are discounted.

5. SHIP'N SAVE will be exonerated from any liability in case of delay resulting from customs procedures or any other cause beyond the control of SHIP'N SAVE or the carrier.

IV. Claims

In case of damages, partial loss, delay, non delivery or other claim, the “shipper” must send a WRITTEN CLAIM to SHIP'N SAVE within seven (7) days of the date of delivery by SHIP'N SAVE except for domestic shipments where damages MUST be reported to SHIP'N SAVE within 48 hours following the delivery.

V. Right to inspect

SHIP'N SAVE, upon its judgment or at the request of governmental authorities, may open and inspect any shipments under its control.

VI. Responsibility for payment

Even if the “shipper” gives SHIP'N SAVE different payment instructions, the “shipper” will always be primarily responsible for all charges including transportation charges and all duties, customs assessments, governmental penalties and fines, taxes, legal costs, related to the shipment in case of default of payment by the consignee or third party. The “shipper” will also be responsible for any costs SHIP'N SAVE may incur in returning the shipment or warehousing it pending disposition.

Standard terms of payment are 30 days.

Even if the shipper defaults on payment SHIP'N SAVE reserves the right to invoice the consignee.

Intra-Canada shipment: Greater of $20 or

International shipments: Greater of $30 or

$0.40 per lb (0.5 kg)

Repackaging

A $10 fee will be charged to repack a parcel that is deemed unship-able.

Insurance

Insurance for the first $100 of value is free. Additional insurance may be purchased with us:

Shipments to U.S. and International destinations: Minimum charge: $10

Shipments within Canada: Minimum charge $10

Oversized parcel

Length over 60 in (152 cm): $12.50 surcharge

Maximum length : 108 in (270 cm)

Length over 108 in (270 cm): $50 minimum surcharge

Maximum weight: 150 lbs (68 kg) per piece : $50 minimum surcharge

Girth: Length + (2 x width) + (2 x height)

Parcel with 2 sides exceeding 30 in (76 cm): $12.50 surcharge.

Girth over 130 in (330 cm): $50 surcharge.

Maximum girth: 165 in (419 cm).

Girth over 165 in (419 cm): $50 minimum surcharge.

Package Restrictions

FedEx Express packaging may be used for Express shipping only, with the exception of FedEx 10 kg and 25 kg boxes. If these boxes are used, the SHIP'N SAVE discount will NOT apply.

Taxes

GST applicable to all shipments in Canada

PST applicable to all shipments in Quebec

HST applicable on shipments for certain provinces

Volume Weight

The chargeable weight is either the gross or the volume weight, whichever is greater.

Volume weight is calculated with the following formulas:

L x W x H (in) = Volume weight in lbs /139 (Int’l)

L x W x H (in) = Volume weight in lbs / 166 (Canada)
